Analogue Partner and End User Agreement and Terms of Use.

The “Analogue” product (“Product”) is a tool designed to collect data from browsing sessions on websites in order to provide information that may be useful to our authorized partners. Use of the Product is subject to the following Terms of Use and Privacy Policy, which are intended to ensure security, privacy and compliance with applicable regulations.
2. Definitions:
- “Authorized Partner“: Refers to any entity or individual previously authorized by Ackaia Corp. to access and use the Product, whose ability to process data has been verified and approved by Ackaia Corp. in accordance with our privacy and legal compliance guidelines.
- “Navigation Data“: Refers to information collected during browsing sessions on websites, including, but not limited to, information about user behavior, browsing preferences and interaction with content.
- “End User”: Refers to the individual interacting with the websites where data is being collected.
2. Conditions of Use:
2.1 Exclusive Access for Authorized Partners
Access to the “Analogue” Product is restricted to Authorized Partners who have passed a rigorous verification process for compliance with Ackaia Corp.’s data protection practices and applicable laws. We will let you know who the authorized partners are.
2.2 Product Objective
The Product was developed for the purpose of collecting browsing data in order to improve the user experience and provide behavioral analysis to Authorized Partners. This data must be used exclusively for the purposes agreed between the parties and in compliance with current privacy legislation.
2.3 Consent and Data Processing
Ackaia Corp. is committed to ensuring that all data collected through the Product is processed in accordance with our privacy and data protection principles. The End User’s consent for data processing will be obtained explicitly and transparently, and Ackaia Corp. undertakes not to collect or store sensitive personal data without due authorization.
2.4 Authorized Partner Responsibility
Authorized Partners are responsible for ensuring that any data collected or processed through the Product is done in compliance with privacy policies and applicable laws. Use of the Product is conditioned on ongoing verification of compliance with the security and privacy principles established by Ackaia Corp.
3. Security and Data Protection
3.1 Security Measures
Ackaia Corp. will adopt all appropriate technical and organizational measures to protect the data collected against unauthorized access, disclosure, alteration or destruction. The information will be stored and processed in a manner that guarantees its integrity, confidentiality and availability.
3.2 Audits and Compliance
Ackaia Corp. will conduct periodic audits to ensure that Authorized Partners maintain security and privacy practices in accordance with established requirements, in addition to ensuring that all applicable laws and regulations are complied with. These audits are disclosed and published in our repository.
4. End User Rights
4.1 Transparency and Access
End Users have the right to access, correct or delete their personal data, as well as revoke consent to the processing of data, as permitted by applicable law. Ackaia Corp. will facilitate the exercise of these rights in accordance with the privacy right policies.
4.2 Anonymization and Data Minimization
Ackaia Corp. adopts the practice of anonymizing data whenever possible, ensuring that personally identifiable data is minimized and processed only for necessary purposes.
5. Prohibitions
5.1 Misuse
Authorized Partners must not use the Product to collect browsing data for any unauthorized purpose, including, but not limited to, marketing without consent, manipulation of personal data, or any other activity that infringes the rights of End Users or violates data protection laws.
5.2 Subcontracting
Authorized Partners shall not subcontract or transfer access to the Product to third parties without the express authorization of Ackaia Corp.
6. Changes to these Terms of Use
Ackaia Corp. reserves the right to update or modify this Term of Use at any time, with due notice to Authorized Partners. Continued use of the Product after such changes constitutes acceptance of the new terms.
7. Final Provisions
7.1 Applicable Law
This Term of Use will be governed by applicable data protection and privacy laws, including, but not limited to, local data protection laws.
7.2 Conflict Resolution
Any disputes arising from these Terms of Use will be resolved in accordance with the dispute resolution mechanisms defined by Ackaia Corp. and the parties involved, with the aim of seeking amicable and effective solutions.
By using the “Analogue” Product, you, as an Authorized Partner, agree to comply with all provisions set forth in these Terms of Use.
